			<content:encoded><![CDATA[<div>Brand new member with a question about safeties, toddlers, and weapon selection.<br />

I’m looking for as subcompact .40 caliber.  This will be my first automatic handgun; therefore I’m a little unsure in what features I want.  I spend a lot of time in the woods and on the water and would like a small lightweight sidearm with respectable firepower I can tote along.  Also to note, when not in the field, the weapon will serve for home defense.  <br />
<br />
Considerations:   Safety is a big one.  My 3 year old accompanies me on some trips and he’s bad about getting into things.  I’m a responsible gun owner and safe, but I’m not sure if a particular safety or lock would provide an advantage and peace of mind.  Is there anything in particular I should look for in a weapon?  At home, I can easily keep the gun out of his reach, but on back country trips...<br />
<br />
After some research I got settled on a Taurus Millennium Pro, but said research also brought up questions about the weapon’s reliability.  What I liked about the Taurus was the light weight (18.7oz), the thumb safety and the proprietary lock system that renders the weapon inoperable and the price is nice.  BUT, after much reading on 3rd gen Millennium’s reliability, I don’t completely trust that I’ll be satisfied with the weapon’s function.  I’m starting to look at other pistols, but I’m not sure how comfortable I am with their safety features or lack of safety features.  My next choice would be Springfield’s XD subcompact.  Should I get over not having a thumb safety available and go with the XD?  &amp; if I go with the XD and don’t have a lockable weapon, what do you do with a weapon when sleeping in the backcountry with a 3 year old?  If I go  with the XD or Glock, I’d have to have to carry a separate trigger lock when sleeping in the tent. <br />

Suggestions?<br />

			<content:encoded><![CDATA[<div>I'm going to Dewey Beach this weekend and was trying to get a hold on the laws of Delaware regarding CCW. I have a Florida non-res permit (I'm from the People's Republic of Maryland) so I know I am that much legal!<br />
<br />
From what I can tell, I cannot carry in:<br />
<br />
Federal buildings (obviously)<br />
&quot;Detention centers&quot; (police departments, etc.)<br />
Places with slot machines<br />
<br />
I can carry in bars and restaurants that serve alcohol, yes?<br />
<br />
One other thing I was unsure of, as a non-res Florida holder, does that mean I would be in legal jeopardy if I were either on school property or within 1000' of a school?<br />

I do not have my CCW yet and will not before the trip, so I know the sidearm has to be transported. I suspect if it is inside a case, with a trigger lock and no ammo is located in the weapon it can be transported in my vehicle as long as it is not within reach of my person while driving. Am I correct? If not can someone enlighten me as to what the rules are for taking my sidearm with me throughout the US when I do not have a CCW permit or license. I would like to take it back east so my brothers and I can share the experience of my new sidearm.</div>

			<content:encoded><![CDATA[<div>A Tampa woman was shot in the leg this afternoon while sitting on the toilet in a hotel bathroom. Police said the woman in the next stall accidentally let her handgun slip out of her waist holster, and the weapon discharged when it hit the ground.<br />
<br />
  The bullet hit 53-year-old Janifer Bliss of Tampa in the lower left leg. She was taken to Tampa General Hospital with what police described as minor injuries.<br />
  The gun belonged to Debra Monce, 56, of Land O'Lakes. She has a concealed weapons permit for the small-caliber handgun, but the case has been referred to the State Attorney's Office for review.<br />
<br />
  The incident happened at the Clarion Hotel, 2701 E. Fowler Ave.<br />

That aid — about $17 billion — is the first piece of the administration's massive stimulus package that can be tracked locally. Much of it has followed a well-worn path to places that regularly collect a bigger share of federal grants and contracts, guided by formulas that have been in place for decades and leave little room for manipulation. <br />

&quot;There's no politics at work when it comes to spending for the recovery,&quot; White House spokesman Robert Gibbs says. <br />

Counties that supported Obama last year have reaped twice as much money per person from the administration's $787 billion economic stimulus package as those that voted for his Republican rival, Sen. John McCain, a USA TODAY analysis of government disclosure and accounting records shows. That money includes aid to repair military bases, improve public housing and help students pay for college.<br />
<br />
The reports show the 872 counties that supported Obama received about $69 per person, on average. The 2,234 that supported McCain received about $34. <br />
<br />
Investigators who track the stimulus are skeptical that political considerations could be at work. The imbalance is so pronounced — and the aid so far from complete — that it would be almost inconceivable for it to be the result of political tinkering, says Adam Hughes, the director of federal fiscal policy for the non-profit OMB Watch. &quot;Even if they wanted to, I don't think the administration has enough people in place yet to actually do that,&quot; he says.<br />

&quot;Most of what they're doing at this point is just stamping the checks and sending them out,&quot; Hughes says.<br />
<br />
The stimulus package Obama signed in February includes about $499 billion in new spending, and to date, the Obama administration has allocated about $158 billion to specific projects and programs. Most of that money has gone directly to state governments, which then disperse the money to prevent school layoffs, repair roads and fund social services. That contrasts with the $17 billion that Washington distributes directly to local communities.<br />

Not all of the money favors places that supported Obama. About a third of the $17 billion, or $5.5 billion, in contracts that the federal government has signed for projects ranging from repaving runways to cleaning up nuclear waste has gone overwhelmingly to counties that supported McCain. <br />
<br />
Jake Wiens, an investigator with the non-profit Project on Government Oversight, says it's too soon to draw meaningful conclusions about whether the type of aid in the stimulus favors Obama's constituents.<br />
<br />
But, he says, &quot;it will be important to pay close attention as the data come in to ensure that political favoritism plays no role.&quot;<br />
<br />
The imbalance didn't start with the stimulus. From 2005 through 2007, the counties that later voted for Obama collected about 50% more government aid than those that supported McCain, according to spending reports from the U.S. Census Bureau. USA TODAY's review did not include Alaska, which does not report its election results by county.</div>

Supreme Court nominee Sonia Sotomayor's opinions show support for the rights of criminal defendants and suspects, skepticism of corporations, and sympathy for plaintiffs alleging discrimination, an analysis of her record by The Washington Post found. And she has delivered those rulings with a level of detail considered unusual for an appellate judge. <br />
<br />
During nearly 11 years on the federal appeals court in New York, Sotomayor has made herself an expert on subjects ranging from the intricacies of automobile mechanisms to the homicide risks posed by the city's population density. Her writings have often offered a granular analysis of every piece of evidence in criminal trials, and sometimes read as if she were retrying cases from her chambers. <br />
<br />
Legal experts said Sotomayor's rulings fall within the mainstream of those by Democratic-appointed judges. But some were critical of her style, saying it comes close to overstepping the traditional role of appellate judges, who give considerable deference to the judges and juries that observe testimony and are considered the primary finders of fact. <br />
<br />
&quot;It seems an odd use of judicial time, given the very heavy caseload in the 2nd Circuit, to spend endless hours delving into the minutiae of the record,&quot; said Arthur Hellman, a University of Pittsburgh law professor and an authority on federal courts. <br />
<br />
Adrienne Urrutia Wisenberg, a Washington criminal appellate lawyer, said appellate judges &quot;are not in the role of reweighing the credibility of a witness. Someone's demeanor is not reflected on a transcript.&quot; <br />
<br />
But Wisenberg said she admires Sotomayor's &quot;tenacious trial lawyer's personality,&quot; and Dan Himmelfarb, a Washington lawyer and former clerk to conservative Supreme Court Justice Clarence Thomas, said Sotomayor is &quot;extraordinarily thorough, and a judge would ordinarily be praised for writing thorough opinions.&quot; <br />
<br />
To examine the record of Sotomayor, whose Senate confirmation hearings begin Monday, The Post reviewed all 46 of her cases in which the 2nd Circuit issued a divided ruling, nearly 900 pages of opinions. Although Sotomayor has heard about 3,000 cases, judicial scholars say split decisions provide the most revealing window into ideology because in such cases the law and precedent are often unclear, making them similar to cases heard by the Supreme Court. President Obama, who nominated Sotomayor to replace retiring Justice David H. Souter, has said Supreme Court justices will be in agreement 95 percent of the time. <br />
<br />
<br />
Sotomayor's votes in split cases were compared with those of other judges through a database that tracks federal appellate decisions nationwide, a random sampling of 5,400 cases. The database codes decisions as &quot;liberal&quot; or &quot;conservative&quot; based on what its creator, University of South Carolina political scientist Donald Songer, says are common definitions. Votes in favor of a defendant, for example, are classified as liberal, while those supporting prosecutors are called conservative. <br />
<br />
Sotomayor's votes came out liberal 59 percent of the time, compared with 52 percent for other judges who, like her, were appointed by Democratic presidents. Democratic appointees overall were 13 percent more liberal than Republican appointees, according to the database analysis. <br />
<br />
Experts said the results show that Sotomayor's ascension would probably not alter the balance of a high court closely divided between conservatives and liberals such as Souter. But they also provide a more nuanced picture of the 17-year federal judge than those offered by her supporters and her critics. <br />
<br />
The White House has portrayed Sotomayor as a tough-on-crime moderate who favors the &quot;judicial restraint&quot; often sought by Republicans, while conservatives call her a liberal activist whose decisions are influenced by ideology and her Latina heritage. <br />
<br />
&quot;She looks like a classic Democrat,&quot; Songer said. &quot;I don't think it's fair to classify her as tough on crime. I would use the term 'moderately liberal,' not 'moderate.' But she certainly seems to be in the mainstream of Democratic judges.&quot; <br />
<br />
The split decisions, which are heavy on the criminal and business cases that tend to dominate the Supreme Court's docket, show Sotomayor voting to overturn convictions or sentences eight times, at a rate comparable to that of other Democratic-appointed judges. Six times, she affirmed them. <br />
<br />
In one case, Sotomayor and seven mostly Democratic colleagues voted to set free a convicted murderer who did not contest his guilt but had been tried on what the court called the wrong murder charge. In another, she joined an opinion that cited flawed jury instructions in throwing out a man's conviction for enticing someone he believed was a 13-year-old girl into sex. <br />
<br />
And when she threw out a life prison term for a convicted heroin dealer, ordering that he be resentenced, Sotomayor wrote that judges should not show &quot;slavish adherence&quot; to the &quot;literal terms&quot; of then-mandatory sentencing guidelines when their language is flawed. The view echoed her criticism of the guidelines from the bench that became an issue in her 1997 confirmation hearings. <br />
<br />
At those hearings, Republicans criticized Sotomayor for apologizing to a defendant for a mandatory minimum sentence she imposed and for calling the sentence an &quot;abomination.&quot; She told senators that the apology expressed her frustration over a feature in the sentencing rules that Congress later changed, conceded she should not have used the word &quot;abomination&quot; and expressed general support for the guidelines. <br />
<br />
Other cases displayed Sotomayor's support for First Amendment protections, campaign finance reforms challenged by conservatives and privacy rights. She ruled against corporations in six of eight business cases. <br />
<br />
Although her decisions are filled with citations of the law and precedent, Sotomayor once pointed to &quot;powerful policy considerations&quot; in allowing a lawsuit against Visa and MasterCard to go forward, and she worried about damage to U.S.-British relations in arguing that British subjects should have access to U.S. courts. Conservatives have criticized Sotomayor for saying in 2005 that &quot;the Court of Appeals is where policy is made. I know this is on tape, and I should never say that.&quot; The White House has defended her, saying the remark was taken out of context. <br />
<br />
Sotomayor, appointed to the appeals court by President Bill Clinton, is a former assistant district attorney in Manhattan and a trial judge, and acquaintances say that background has helped shape her judicial style. She overturns lower courts at roughly the same rate as other Democratic appointees. Her writings are full of details from the trial record, especially in criminal matters, where she often meticulously analyzes witness testimony. <br />
<br />
When she reinstated a verdict against Ford Motor Co. in 2002 in the lawsuit of a woman who said her van suddenly accelerated without her touching the gas pedal, Sotomayor wrote that one witness's testimony &quot;requires two simultaneous malfunctions in the cruise control circuitry. The first is an open ground connection to the speed amplifier, resulting from a loose or broken wire.&quot; <br />
<br />
Last year, in voting to overturn a firearms defendant's sentence, Sotomayor joined a Democratic appointee and a Republican in analyzing whether New York City's dense population puts bystanders at greater risk from gunfire than those elsewhere. She wrote a separate dissent, acknowledging that the trial judge's opinion on the subject was &quot;detailed'' but citing government reports and newspaper articles to argue it was &quot;insufficient&quot; to support a sentence above the range recommended by federal guidelines. <br />
<br />
A Republican appointee who disagreed wrote that &quot;appellate courts are not factfinders. . . . I do not understand it to be our role . . . to engage in this kind of dissection of the empirical evidence cited by the district court. Nor is it to identify competing studies or news articles pointing in other directions.&quot; <br />
<br />
In 2004, Sotomayor appeared to go beyond the facts established at trial in arguing that two teenage girls were illegally strip-searched at Connecticut juvenile detention facilities. Their lawsuit against the state was dismissed by a federal judge but reinstated in an opinion written by a Democratic 2nd Circuit appointee, who said four of the strip searches at issue were unlawful but four others were legal. <br />
<br />
Sotomayor dissented, arguing that all were illegal and blasting any strip search as &quot;severely intrusive.&quot; Citing documents from pretrial discovery, she broke down all 34 strip searches at the facilities in which contraband was found on a prisoner from 1995 to 2000 -- searches that were not part of the lawsuit. She concluded that there was &quot;absolutely no evidence that suspicionless strip searches were necessary.&quot; <br />
<br />
(The Supreme Court last month voiced skepticism of strip-searching teenage girls, ruling 8 to 1 that Arizona school officials violated the constitutional rights of a 13-year-old girl when they strip-searched her on suspicion that she might be hiding ibuprofen in her underwear.) <br />
<br />
Hellman, the law professor, called Sotomayor's approach &quot;a kind of carpet-bombing, a relentless mustering of facts. She goes well beyond what is necessary for the case and is determined not to just defeat the other side, but to annihilate it.&quot; <br />
<br />
Sotomayor's style is consistent even when she finds against defendants, such as when she affirmed the conviction of a child pornography defendant in 2004. A U.S. district court judge had concluded after an evidentiary hearing that the man was innocent but denied his petition because it was filed too late. <br />
<br />
Even though she had decided the core issue -- the conviction -- Sotomayor broke down the witnesses and testimony at the judge's hearing. She concluded that his finding of innocence was &quot;clearly erroneous,&quot; even as she said that district courts &quot;are generally best placed to evaluate testimony in light of the witnesses' demeanor.&quot; <br />
<br />
A fellow Democratic appointee, Judge Rosemary S. Pooler, dissented. Sotomayor's opinion, she wrote, was based on &quot;speculations and conjectures&quot; and disregarded the judge's &quot;role as the finder-of-facts.&quot; <br />
<br />
&quot;It is inappropriate in all but the most extraordinary cases for this Court to second-guess a district court's credibility findings,&quot; Pooler concluded. &quot;The majority's dissection of the district court's decision departs from our precedents and wrongly supplants the lower court's assessment of the evidence with its own factual inferences, never having seen or heard any of the testimony that it now seeks to discredit.&quot;</div>

Amendment Revising Federal Switchblade Act Introduced, Supported by the Administration<br />
Truth Squad members, we introduced this issue several weeks ago on the radio, and many of you wrote Customs to protest the move to ban your pocket knives. My good friend, Doug Ritter -- founder of Knife Rights -- has been working on this almost without sleep for weeks, and we are almost there. <br />

We're going to ask you to write yet again, because your letters and emails and faxes are WORKING. You are the ones who have made this happen. <br />
While our primary focus had been on stopping funding for Customs relating to their proposed rule, another track was being worked in the background that would permanently solve the problem. It was initially conceived as a follow-up to the urgently required need to stop Customs dead in its tracks, giving us time to work on a more permanent solution. Late Tuesday evening, even as we were marshaling support for the Cornyn-Wyden stop funding amendment, we received an amendment introduced by Senators Pryor (D-AR) and Hatch (R-UT) that would revise the Federal Switchblade Act (FSA); an amendment that was being supported by Customs.<br />
It was a good start, but was not quite acceptable for a variety of reasons. Knife Rights led an effort to &quot;perfect&quot; the language of the amendment. Working with our attorneys and AKTI representatives late into the night and early morning hours, Knife Rights drafted language that we felt would permanently solve the issue. With the cooperation of AKTI and NRA lobbyists this revised language was handed off to Sen. Pryor who worked to get Customs to accept the revised language. After a concerted effort by Sen. Pryor, a consensus revision emerged that had the support of Customs and was acceptable to Knife Rights and the industry. Late today a new Amendment Number 1447 was introduced by Senators Cornyn, Pryor, Hatch, Vitter, Risch, Chambliss, Corker, Enzi, Barrasso, Graham, Roberts, Wyden and Crapo that adds another Exception in Section 1244 that clearly covers conventional assisted openers and one-hand openers. It's not perfect, but it's good enough and a major step forward. Even better, it is a permanent solution rather than a stop-gap measure.<br />

This cooperative effort has resulted in a bi-partisan amendment that has the critical support from the Senate committees which have responsibility for the FSA and which is endorsed by the Administration (Customs and Border Production have signed off on it). That gives it a very good chance of making it through the process, but first we have to get it voted into the Homeland Security Appropriations Bill.<br />
NONE of this would have occurred without the groundswell of negative reaction to the Customs proposal. Your thousands of written letters mailed to Customs and the thousands more emails and faxes sent to Members of Congress asking them to stop Customs, are what raised the issue to a level where it could no longer be ignored. As the efforts by Knife Rights and AKTI garnered more support from others with more political pull, that led to the Congressional Sportsmen's Caucus' letter to Sec. Napolitano. It all added up to a great deal of pressure on Customs to fix the problem. Customs has responded, to their credit.<br />
The coalition of advocacy groups including Knife Rights, American Knife and Tool Institute, National Rifle Association, Congressional Sportsmen Foundation, Second Amendment Foundation, Citizens Committee for the Right to Keep and Bear Arms and others were able to leverage YOUR outrage into an effective political force in a very short time. None of us individually could have done it alone and it would not have happened without the grassroots support you have provided. You deserve to pat yourself on the back for this effort to get it this far. In an age when we often feel like Congress and the Administration simply ignore the citizens' wishes, this is an example of them actually listening to the citizens. YOU made this happen!<br />
Now, we need to get the job finished. The next step is a vote on this Amendment in the Senate. Yes, that means it is time to write again. And, hopefully you'll need to write again to support an effort to get it through Conference Committee. That we are in a position to ask you to do this is proof positive that it works. Thirty-eight percent (38%) Strongly Disapprove giving Obama a Presidential Approval Index rating of –8. The President’s Approval Index rating has fallen six points since release of a disappointing jobs report last week (see trends). <br />

There is a gender gap when it comes to perceptions of Obama’s performance. By a 46% to 27% margin, men Strongly Disapprove. Women are more evenly divided—33% Strongly Approve and 30% Strongly Disapprove. <br />

Thirty-four percent (34%) of voters nationwide say the U.S. is heading in the right direction, the lowest level of optimism since mid-March. The Rasmussen Index shows consumer and investor confidence are down again today reaching the lowest level in three months. The Discover U.S. Spending Monitor fell for the first time in three months. A Rasmussen video report notes that 46% want the government to stay out of the housing market. <br />

The Presidential Approval Index is calculated by subtracting the number who Strongly Disapprove from the number who Strongly Approve. It is updated daily at 9:30 a.m. Eastern (sign up for free daily e-mail update). Updates also available on Twitter. <br />

In New Jersey, Republican Chris Christie continues to lead incumbent Governor Jon Corzine. <br />

Daily tracking results are collected via telephone surveys of 500 likely voters per night and reported on a three-day rolling average basis. The margin of sampling error—for the full sample of 1,500 Likely Voters--is +/- 3 percentage points with a 95% level of confidence. Like all polling firms, Rasmussen Reports weights its data to reflect the population at large (see methodology). Among other targets, Rasmussen Reports weights data by political party affiliation using a dynamic weighting process. While partisan affiliation is generally quite stable over time, there are a fair number of people who waver between allegiance to a particular party or independent status. Over the past four years, the number of Democrats in the country has increased while the number of Republicans has decreased. <br />
<br />
Our baseline targets are established based upon separate survey interviews with a sample of adults nationwide completed during the preceding three months (a total of 45,000 interviews) and targets are updated monthly. Currently, the baseline targets for the adult population are 39.0% Democrats, 32.5% Republicans, and 28.5% unaffiliated. Likely voter samples typically show a slightly smaller advantage for the Democrats. <br />

When he isn't running for governor, Mike Cox is Michigan's attorney general. And it was in his capacity as the state's top law enforcement officer that Cox announced with considerable fanfare Tuesday that his office has filed an amicus brief asking the U.S. Supreme Court to strike down a strict gun control ordinance in Chicago.<br />
If you are wondering how a man with two full-time jobs has time to worry about what local officials in Illinois are up to, the press release issued by the AG's office (&quot;Cox Joins NRA in Fight against Chicago Gun Ban&quot;) provides a clue.<br />
Get it? Michigan's attorney general (did we mention he's running for governor?) is backing the National Rifle Association, which has the political clout to make or break gubernatorial wannabes like Cox and isn't afraid to use it, in its valiant fight against Chicagoans who want fewer handguns in their city.<br />
And just to show he's not afraid to put your money where his political interests lie, Cox is deploying the AG's own taxpayer-supported staff to do it.<br />
Let's suppose, for the sake of argument, that a panel of U.S. Court of Appeals judges got it wrong when they unanimously upheld Chicago's gun control ordinance.<br />
Let's suppose the citizens of Chicago (a city like Detroit, only larger and safer) violated the U.S. Constitution when they proposed to regulate the sort of weapons that people could carry in their city.<br />
And just to be charitable, let's forget that Michigan's attorney general made his reputation as a homicide prosecutor in Detroit, where another fellow might have learned something about what the unregulated proliferation of handguns can do to a city.<br />
Don't Michiganders still have every reason to wonder what their attorney general is doing sticking his nose in Chicago's fight?<br />
The obvious answer is that Cox is in that fight to curry favor with the one of the nation's most potent political lobbies. He wants his party's gubernatorial nomination, and he's pulling out all the stops to get it.<br />
We just wish he would do it on his own time, and with his own money.

<i><font size="2"><font face="Times New Roman, serif">MICHIGAN ATTORNEY GENERAL</font></font></i>The Free Press editorialized Wednesday -- &quot;Your taxes at work for the NRA (and Cox)&quot; -- against my filing of a legal brief with the U.S. Supreme Court that supports the National Rifle Association's challenge of a Chicago ordinance banning the possession of most handguns.<br />
My support for this challenge to the Chicago gun ban is rooted in Michigan's own Constitution, which states: &quot;Every person has a right to keep and bear arms for the defense of himself and the state.&quot;<br />
My defense of this constitutional principle is longstanding. In 2007, I filed an amicus brief with the U.S. Supreme Court in opposition to the District of Columbia's drastic ban on guns, arguing that the Second Amendment's right &quot;to keep and bear arms&quot; is an individual right. The Supreme Court agreed with that position and overturned the D.C. ban in its Heller decision.<br />
The Free Press failed to mention that 34 attorneys general signed on to the NRA's challenge of Chicago's strict gun ban, including both Democrats and Republicans. This isn't about politics; it's about standing up for principle.<br />
It may come as news to the Free Press, but this office files amicus briefs all the time to protect the rights of the state and its citizens. For example, this office has filed amicus briefs in support of the Big Three auto industry and tougher standards to protect the Great Lakes.<br />
In my own experience of more than 13 years as a homicide prosecutor and head of the homicide unit of the Wayne County Prosecutor's Office, I never saw anyone charged with murder who had a license to legally carry a concealed weapon. Most people who want to possess guns are law-abiding and present no threat to others. Rather than the availability of weapons, my experience is that gun violence is driven by culture, police presence, or the lack of same, and failures in the supervision of parolees and probationers.<br />
Since becoming attorney general, I have worked to ensure that the rights of Michigan citizens to defend themselves are protected. For example, I have expanded the number of states that recognize Michigan CCW permits from eight states to 35 states. And I'll continue to take action when constitutional priciples are threatened.<br />
I make no apologies for my support of the Constitution and the Second Amendment.<br />
